Companies often make big promises to employees to convince them to accept their job offers. For example, they might offer excellent salary and benefits, promise to provide staff and financial support to help you succeed at your job, claim the company has an excellent financial track record, or assure you that you will have long-term job security.
But unfortunately companies sometimes exaggerate or outright lie when they are hiring new employees. Sometimes these types of fraud or misrepresentation by employers can be legally actionable.
Protections Against FraudThe ideal way to protect you from these types of false promises is to enter into a clear written employment contact. However, that is not always a viable option. But even if you do not have an employment contract, you could have a legal claim if your new employer lied to convince you to accept its job offer. More specifically, you might have a claim for employment fraud or misrepresentation.
Employment fraud most commonly occurs when a company makes false promises to convince you to leave another job, relocate from another state, or make other significant financial or personal commitments. In New Jersey this can be legally actionable even if you were hired as an employee at-will, meaning someone who can be fired for almost any reason or even for no reason at all.
