Gender discrimination occurs when your employer treats you differently because of your sex. It violates the New Jersey Law Against Discrimination ("LAD"), the New York Human Rights law ("NYHRL") and Title VII of the Civil Rights Act of 1964 ("Title VII"). Nonetheless, gender discrimination is far too common in today’s workforce.
Gender discrimination (also known as sex discrimination) typically occurs when a company discriminates against women by favoring men when making decisions about who it should hire, promote demote, give a raise, layoff or fire.
Even though women much more frequently experience sex discrimination in the workplace, both men and women can be the victims of sex discrimination. Either way, it is a violation of your employment law rights in both New Jersey and New York if your employer treats you worse based on your sex or a gender stereotype. As a result, it is a violation of your employment law rights if your gender is the reason you hit the corporate “glass ceiling,” are being underpaid compared to your peers or were wrongfully terminated.
Sexual Harassment is a Form of Gender DiscriminationSexual harassment, which is harassment due to gender, is another form of legally prohibited gender discrimination. While sexual harassment often can be sexual in nature, any form of harassment based on your gender can be part of a sexual harassment claim if it contributes to making your work environment hostile or abusive.
